TERMS OF USE.

Agreement

These Terms of Use ("Terms") are a legal agreement between you and Cosine Technologies LLC ("Cosine", "we", "us") and govern your use of the Huqqs iOS application ("Huqqs" or "the App"). By downloading, installing, or using Huqqs, you agree to these Terms. If you do not agree, do not use the App.

Apple's Standard EULA applies

Huqqs is distributed through the Apple App Store. Your use of the App is also governed by Apple's Standard End User License Agreement (EULA). That EULA is incorporated here by reference and controls the license grant, usage rules, warranty disclaimers, and Apple's role as a third-party beneficiary. These Terms supplement — they do not replace — the Apple Standard EULA.

What Huqqs does

Huqqs is a music visualizer and live-lyrics app for iPhone and iPad. It listens to music playing around you through your device's microphone, identifies songs via Apple's ShazamKit framework, fetches time-synced lyrics, and renders reactive Metal-based visuals that move with the music. A dancing pet companion can appear on screen. Huqqs does not play music or provide a music library.

Huqqs Pro subscriptions

Early access (current state): Huqqs is free to download and every feature is unlocked for everyone — no subscription is available or required. The pricing, billing, and cancellation terms below describe how a Huqqs Pro subscription will work when introduced in a future update. They take effect only once the subscription is activated in the app.

Huqqs is free to download. Once activated, certain features will be available only with a Huqqs Pro subscription.

Plans and pricing

Prices shown are in US Dollars. Prices in other territories are set by Apple's regional pricing tiers and may vary. Applicable taxes may be added. The currently-offered price will be displayed in the App's subscription screen before you confirm a purchase.

Billing and auto-renewal

• Payment is charged to your Apple ID account at confirmation of purchase.
• Your subscription automatically renews at the same price and billing period unless you cancel at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• If offered, the free trial portion of a subscription is forfeited when you purchase Huqqs Pro before the trial ends.

Managing and cancelling

You can view, manage, and cancel your subscription at any time:

• On your iPhone/iPad: Settings → [your name] → Subscriptions
• Online: apps.apple.com/account/subscriptions
• From inside Huqqs: Settings → Manage Subscription

Cancelling stops the next auto-renewal; you retain Pro access until the end of the period you've already paid for. Deleting the App does not cancel the subscription.

Refunds

All subscription purchases are processed by Apple. Refund requests are handled under Apple's refund policy. Cosine cannot issue refunds for App Store purchases directly.

Restore purchases

If you reinstall Huqqs or switch devices while signed into the same Apple ID, you can restore an existing subscription from the App's paywall via the "Restore Purchases" button.

License

Subject to these Terms and the Apple Standard EULA, Cosine grants you a personal, non-exclusive, non-transferable, revocable license to install and use Huqqs on Apple devices you own or control, solely for personal, non-commercial use. All rights not expressly granted are reserved by Cosine.

Acceptable use

You agree not to:

• Reverse-engineer, decompile, or disassemble the App, except to the extent permitted by applicable law.
• Copy, modify, distribute, sell, sublicense, or create derivative works based on the App.
• Use the App to violate any law, infringe any third-party intellectual-property right, or harass others.
• Attempt to bypass, disable, or interfere with security features, rate limits, or subscription checks.
• Use the App to record, reproduce, or redistribute copyrighted music, lyrics, or visuals in a way that exceeds what's permitted by the source rights-holders.

Third-party services and content

Huqqs integrates with third-party services, each governed by its own terms. Song identification uses Apple ShazamKit; lyrics come from Musixmatch and LRCLIB; song genre and duration are looked up via the public iTunes Search API. Huqqs does not own the underlying lyrics or music metadata displayed; those are licensed from or sourced by those third parties. See our Privacy Policy for the full list.

Intellectual property

The Huqqs name, logo, visual stages, shader code, pet designs, UI, and all associated original content are the property of Cosine Technologies LLC and are protected by copyright, trademark, and other intellectual-property laws. These Terms do not grant you any right to use Cosine's trademarks.

Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, COSINE DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Song identification accuracy depends on ShazamKit; lyrics availability depends on third-party providers; visual output depends on your device's capabilities. We do not warrant that the App will be error-free, uninterrupted, or that every song will be recognized or have lyrics available.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL COSINE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP. COSINE'S TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO COSINE (THROUGH APPLE) IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow these limitations, so portions may not apply to you.

Governing law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. Any dispute arising under these Terms is subject to the exclusive jurisdiction of the state and federal courts located in California. The Apple Standard EULA's separate governing-law provisions continue to apply to matters it covers.

Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Effective" date at the top of this page. Your continued use of the App after an update constitutes acceptance of the revised Terms.

Termination

We may suspend or terminate your access to the App if you materially breach these Terms. You may stop using the App at any time by deleting it. Termination of these Terms does not cancel an active subscription; you must cancel through Apple as described above.
